On the 18th of January 2023, the European Data Protection Board (“EDPB”) adopted a report by the Cookie Banner Task Force for the work carried out in ensuring a consistent approach to cookie banners across the European Economic Area (“EEA”).

The Cookie Banner Task Force was established in September 2021 to coordinate the response to complaints received about cookie banners filed with numerous EEA Data Protection Authorities (“DPAs”) by NYOB.

The Task Force aimed to promote cooperation, information sharing and best practices amongst the DPAs, which has been instrumental in ensuring a consistent approach to cookie banners across the EEA.

From the report it will be noted that the various DPAs agreed upon a common denominator in their interpretation of the applicable provisions of the ePrivacy Directive and the General Data Protection Regulation (“GDPR”) on issues such as reject buttons, pre-ticked boxes, banner designs or withdraw icons.
